The High Court Division on Thursday stayed for five months Rajuk’s order cancelling Justice Miftah Uddin Choudhury’s five-katha plot at  extended 3rd phase of Uttara  in the capital that was allotted to him on December 17, 2004.

A bench of Justice Syed Refaat Ahmed and Justice Md Iqbal Kabir in the same order also directed Rajuk not to allot the plot to anyone else in five months   

The bench also directed the Rajuk to receive pay order amounting Tk 12 lakh as payment of 2nd and 3rd instalment for the plot handed over to Justice Miftah Uddin Choudhury by registering the deed.

The bench in a rule asked the government and Rajuk to explain in four weeks why the Rajuk’s order issued on July 8, 2019 cancelling allotment of the plot no 9 at road no 2 and sector 15-1 in Uttra Residential area would  not be declared as illegal.

In the same rule the respondents were also asked to explain in four weeks why they would not be directed to receive the pay orders as payments of the 2nd and 3rd instalments.

The bench passed the orders after hearing a writ petition filed by Justice Miftah Uddin Choudury challenging the legality of the Rajuk’s order.
